Caravan park businesses are often the backbone of local economic success, generating jobs across the community and also playing a vital role in protecting the local environment.
The introduction of caravan parks has allowed for industry regulation and has provided a mechanism by which local authorities can ensure visitors to their regions increase opportunities and prosperity while protecting the interests of the local area.
From humble beginnings
NSW caravan parks came about as a way of organising the caravanning community, ensuring local interests and the environment were protected and respected by visitors.
Caravan parks offer affordable and accessible holiday accommodation and help to bring regional communities to life.
The caravan and camping industry works alongside other tourism product and experience providers and local tourism bodies to create strong tourism communities which attract visitor spending.
Growing success
Caravan and camping holidays have long been a popular choice for Australians and in times of uncertainty, they have proven to offer the security, comfort and space people are looking for. In NSW visitor nights remained steady throughout the 2021 lockdowns.
The value of the caravan and camping industry to rural and regional communities continues to grow. Every $1.00 generated in direct output associated with the operation and tourism of caravan parks, $1.53 is contributed to GDP. For every $1m of direct output the industry creates 12 full time jobs.
Over the past 50 years, NSW caravan parks have played a vital role in ensuring visitors to our regions are offered a quality holiday accommodation experience, as well as protecting the local natural environment, social cohesion of communities and providing a means of regulating this form of tourism.

The role of council
Local councils play an important role in supporting caravan and camping tourism in their region.
They are the consent authority for new developments, as well as for improvements and changes to existing parks. Councils closely regulate the renewal of and compliance with approvals to operate and they provide important oversight of the balance between local tourism and the needs of the community, including income generation and environmental protection.
Councillors and council staff are responsible under the Local Government Act 1993 as the regulator of caravan parks in their local government area.
It’s also important for local councils to be aware of and understand other legislation, regulations and policies that apply to these important businesses. These include:
Applying to the State, the new Housing SEPP consolidates five housing-related policies, including State Environmental Planning Policy No 21 – Caravan Parks and State Environmental Planning Policy No 36 – Manufactured Home Estates. As such it includes planning rules for caravan parks and manufactured home estates.
The principles of this Policy are as follows—
(a) enabling the development of diverse housing types, including purpose-built rental housing,
(b) encouraging the development of housing that will meet the needs of more vulnerable members of the community, including very low to moderate income households, seniors and people with a disability,
(c) ensuring new housing development provides residents with a reasonable level of amenity,
(d) promoting the planning and delivery of housing in locations where it will make good use of existing and planned infrastructure and services,
(e) minimising adverse climate and environmental impacts of new housing development,
(f) reinforcing the importance of designing housing in a way that reflects and enhances its locality,
(g) supporting short-term rental accommodation as a home-sharing activity and contributor to local economies, while managing the social and environmental impacts from this use,
(h) mitigating the loss of existing affordable rental housing.

The purposes of this Act are as follows—
(a) to provide the legal framework for the system of local government for New South Wales,
(b) to set out the responsibilities and powers of councils, councillors and other persons and bodies that constitute the system of local government,
(c) to provide for governing bodies of councils that are democratically elected,
(d) to facilitate engagement with the local community by councils, councillors and other persons and bodies that constitute the system of local government,
(e) to provide for a system of local government that is accountable to the community and that is sustainable, flexible and effective.

The object of this Regulation is to provide opportunities for affordable alternatives in short-term and long-term accommodation by setting standards—
(a) for the design of manufactured home estates, caravan parks and camping grounds, and
(b) for the design and construction of manufactured homes and other moveable dwellings, and
(c) for the siting of manufactured homes and other moveable dwellings, and
(d) to promote the health, safety and amenity of the occupiers of manufactured homes and other moveable dwellings.

The objects of this Act are as follows—
(a) to improve the governance of residential communities,
(b) to set out particular rights and obligations of operators of residential communities and home owners in residential communities,
(c) to enable prospective home owners to make informed choices,
(d) to establish procedures for resolving disputes between operators and home owners,
(e) to protect home owners from bullying, intimidation and unfair business practices,
(f) to encourage the continued growth and viability of residential communities in the State.

Subordinate legislation that supports the operation of the Residential (Land Lease) Communities Act 2013. It contains provisions regarding:
- Publication of particulars of enforcement and disciplinary action and information about residents committee
- Standard form of site agreement – Scheule 1
- Form of site condition report – Schedule 2
- Prohibited terms of site agreement
- Retaliatory conduct
- Sewage charges and maximum service availability charges for utilities payable by home owners
- Determining the percentage of home owners for the purposes of sections 50(3) (Special levy for community upgrade) and 69 (2) (Mediation)
- Period for making applications to Tribunal regarding disputes as referred to in section 156(2) of the Act – Schedule 3
- Penalty notice offences and penalties – Schedule 4
- Savings and transitional provisions – Schedule 5
Contains provisions setting out the rights and responsibilities of tenants, landlords and property managers in NSW. This includes:
- Starting a tenancy, including residential tenancy agreements
- Rental bonds
- Rent and other charges
- Rights and obligations of landlords and tenants
- Occupation and use
- Alterations, additions and repairs
- Termination of tenancy agreements
- Resolving disputes
- Enforcement
- Residential tenancy databases
Subordinate legislation that supports the operation of the Residential Tenancies Act 2010. It contains provisions regarding:
- Standard form of residential tenancy agreement (Schedule 1), prohibited terms
- Disclosure of information to tenants
- Charges for sewerage and utilities
- Smoke alarms
- Fixtures or alterations, additions or renovations to residential premises
- Exemptions for certain housing types
- Times for making applications to Tribunal
- Exemptions in response to COVID-19 pandemic
- Savings and transitional provisions
- Standard form of condition report – Schedule 2
- Declaration by competent person (where terminating a tenancy in circumstances of domestic violence)
- Penalty notice offences
Sets out the rights and obligations of operators and long-term casual occupants of caravan parks who install their own moveable dwellings on a site in the park and use it for holiday purposes. It contains provisions regarding:
- Rights of prospective occupants to be provided with information
- Occupation agreements, including terms (Schedule 1)
- Occupant fees and charges
- Park rules for casual occupants
- Resolving disputes
- Recovery of possession
- Abandoned sites
- Investigations and enforcement
- Savings and transitional provisions
This Act is available for the disposal of uncollected goods where there is no agreement between the parties on the means of their disposal. It gives a person in possession of goods the right to dispose of them after a certain amount of time and sets out the process for doing so. Available for operators of caravan parks and manufactured home estates to deal with uncollected goods.
Subordinate legislation that supports the operation of the Uncollected Goods Act 1995.
